These Terms of Service govern your use of the Novame platform, website, and related services. By accessing or using Novame, you agree to these Terms. If you do not agree, you must not use the service.

1. Overview of the Service

Novame provides digital tools designed to help users build personalized skincare routines and supportive nutrition guidance for skin wellness. The platform may include:

• AI-generated skincare routines
• Cosmetic skin assessments
• Age estimation tools
• Skin appearance analysis from photos
• Lifestyle and nutrition suggestions related to skin wellness
• Product recommendations
• Routine tracking and comparison tools

The service uses a combination of expert-informed frameworks, artificial intelligence systems, and user-provided information and images. Novame is designed for educational and cosmetic wellness purposes only.

2. No Medical Advice

Novame does not provide medical advice, diagnosis, or treatment. The information, recommendations, and routines generated by Novame are informational only, are not medical advice, and are not a substitute for professional healthcare guidance.

You should consult a licensed physician or dermatologist for medical skin conditions, persistent skin issues, allergic reactions, medication-related concerns, or dermatological treatment decisions. Do not rely on Novame to diagnose or treat medical conditions.

3. Not a Medical Device

Novame is a cosmetic wellness tool. The platform is not a medical device and is not regulated by the U.S. Food and Drug Administration (FDA) or equivalent regulatory bodies.Novame does not claim to diagnose, treat, cure, or prevent any disease.

4. Artificial Intelligence and Limitations

Novame uses artificial intelligence systems to generate personalized recommendations. These systems may include external AI models operated by third parties such as OpenAI, Anthropic (Claude), and other large language model providers. User information may be processed by these systems to generate outputs.

AI-generated results may contain errors, may be incomplete, may not reflect current scientific consensus, and may not apply to your specific situation. AI outputs should be considered informational suggestions only. You agree that AI systems are not perfect and may produce inaccurate or misleading results. Use of Novame is at your own risk.

5. Expert Contributions

Novame's frameworks, methodologies, and educational structures may be developed with input from professionals such as dermatology professionals, nutritionists, cosmetology specialists, and skincare experts. However, these experts do not review every user result, do not provide individual consultations through the platform, and AI generates the final personalization. Outputs are therefore automated and not professional advice.

6. User Responsibilities

By using Novame, you agree that:

• You are responsible for your own skincare decisions
• You will use products cautiously and perform patch testing when appropriate
• You will seek professional medical care when necessary
• You will not rely solely on Novame for health-related decisions

Novame is not responsible for reactions, outcomes, or skincare results.

7. Prohibited Uses

You agree not to use Novame to:

• Attempt to reverse-engineer, scrape, or extract data from the platform
• Upload images of individuals without their explicit consent
• Use the platform for any unlawful or fraudulent purpose
• Attempt to circumvent security features or access controls
• Impersonate another person or entity
• Use automated tools, bots, or scripts to access the service without written permission
• Resell, redistribute, or commercially exploit platform outputs without authorization

Novame reserves the right to suspend or terminate access for violations of this section.

8. Photo Uploads, Skin Analysis, and Biometric Data

Novame may allow users to upload facial images to enable cosmetic skin analysis, visual skin condition estimation, routine tracking over time, skin appearance comparisons, and age estimation models.

By uploading photos you agree that:

• Novame may store and process these images
• Novame may analyze them using AI systems
• The analysis is cosmetic and informational only

Photo-based analysis may include automated estimates related to visible skin features, skin appearance patterns, and cosmetic aging indicators. These analyses are not medical evaluations.

Certain U.S. states, including Illinois (BIPA), Texas, and Washington, have laws governing the collection and use of biometric identifiers. To the extent facial images uploaded toNovame constitute biometric data under applicable state law, by using the service you provide informed written consent to Novame's collection, storage, and use of such data for the purposes described in these Terms and our Privacy Policy. You may withdraw consent and request deletion at any time by contacting support@novame.care.

9. User-Generated Content

By submitting photos, responses, or other content to Novame, you grant KloudStep LLC a non-exclusive, worldwide, royalty-free license to store, process, and use that content solely for the purpose of providing the service to you. You retain ownership of your content. Novame will not sell or share your content with third parties for marketing purposes without your consent, as described in our Privacy Policy.

10. Data Storage and Skin Tracking

To provide the service, Novame may store onboarding answers, skincare routines, uploaded images, routine history, and analysis results. This information may be used to generate personalized routines, improve AI systems, compare skin appearance over time, and provide progress tracking. Users acknowledge that their data may be stored in Novame's systems for these purposes.

11. Third-Party Services and Tracking Technologies

Novame may use third-party technologies including Google Analytics, Meta Pixel, Klaviyo, Supabase, cloud hosting providers, and AI service providers. These tools may collect limited usage or technical information to help analyze product usage, improve the platform, measure performance, and provide core infrastructure. Use of Novame implies consent to these technologies as described in our Privacy Policy.

By creating an account or submitting your email, you consent to receive transactional and marketing communications from Novame via email. You may opt out at any time by clicking "Unsubscribe" in any email or contacting support@novame.care.

12. Data Security

Novame takes reasonable steps to protect user data including encrypted password storage, secure authentication systems, encrypted data storage where appropriate, and restricted internal access. However, no online system is completely secure. Novame cannot guarantee the absolute security of information.

13. User Accounts

To use certain features you may be required to create an account. You agree to provide accurate information, maintain the confidentiality of your login credentials, and notifyNovame if you suspect unauthorized access. Users are responsible for all activity occurring under their account.

14. Subscriptions and Billing

Novame may offer paid subscription plans that provide access to paid features. By subscribing to a paid plan, you agree to the following:

• Automatic Renewal: Subscriptions will automatically renew at the end of each billing period (6-month or annually, depending on your plan) unless you cancel before the renewal date.
• Cancellation: You may cancel your subscription at any time through your account settings or by contacting support@novame.care. Cancellation will take effect at the end of your current billing period.
• Access After Cancellation: If you cancel your subscription, you will retain access to paid features until the end of your current paid billing period. After that date, your account will revert to free tier access.
• Price Changes: Novame reserves the right to change subscription prices. We will notify you of any price changes before your next billing cycle. Continued use after a price change constitutes acceptance of the new price.
• Refunds: Subscription fees are generally non-refundable, except where required by applicable law or as otherwise stated in our refund policy.

15. Eligibility

You must be at least 18 years old to use Novame. By using the platform you confirm that you are at least 18 and have the legal capacity to agree to these Terms. Novame is not intended for children.

16. Limitation of Liability

To the maximum extent permitted by law, Novame and KloudStep LLC shall not be liable for skincare outcomes, allergic reactions, product reactions, personal health consequences, inaccuracies in AI outputs, or decisions made based on platform content. Novame is provided "as is" and "as available" without warranties of any kind.

In no event shall Novame's total liability to you exceed the greater of (a) the amount you paid to Novame in the six months preceding the claim, or (b) one hundred U.S. dollars ($100).

17. Indemnification

You agree to indemnify and hold harmless Novame and KloudStep LLC from any claims, damages, or liabilities arising from your use of the service, your reliance on AI-generated outputs, or your violation of these Terms.

18. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use ofNovame shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Wyoming, United States, unless otherwise required by applicable law.

You and KloudStep LLC each waive the right to a jury trial and the right to participate in any class action, class arbitration, or representative proceeding. Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.

If any part of this arbitration provision is found unenforceable, the remainder shall remain in effect and the unenforceable part shall be severed.

19. Intellectual Property

All content on Novame including software, AI systems, design, algorithms, text, images, and branding is owned by Novame or its licensors and is protected by intellectual property laws. Users may not reproduce, distribute, or commercially exploit the platform without written permission.

20. Termination

Novame may suspend or terminate user access at any time if the Terms are violated, fraudulent activity is suspected, or misuse of the service occurs. Users may stop using the service at any time.

21. Service Discontinuation

Novame and KloudStep LLC reserve the right to modify, suspend, or permanently discontinue the platform, in whole or in part, at any time and for any reason, including but not limited to:

• Business or operational decisions
• Technical or infrastructure constraints
• Legal or regulatory requirements
• Commercial viability

In the event of permanent discontinuation, Novame will make reasonable efforts to provide advance notice to registered users via email. Upon discontinuation, access to the platform and any stored data may no longer be available.

Novame is not liable for any loss, inconvenience, or damages resulting from the suspension or permanent discontinuation of the service.

If you wish to export or retrieve your data prior to any service changes, you may contact support@novame.care.

22. Data Access and Deletion

Users may request access to their stored data, correction of personal data, or deletion of their account and stored data. Requests can be made by contacting support@novame.care. Some data may be retained if required for legal or security purposes.

23. California Privacy Rights (CCPA/CPRA)

If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA):

• Right to Know: You may request disclosure of the categories and specific pieces of personal information we have collected about you.
• Right to Delete: You may request deletion of personal information we have collected from you, subject to certain exceptions.
• Right to Correct: You may request correction of inaccurate personal information we hold about you.
• Right to Opt-Out: You may opt out of the sale or sharing of your personal information. Novame does not sell personal information for monetary consideration. We may share limited data with advertising partners; you may opt out by contacting us.
• Right to Non-Discrimination: We will not discriminate against you for exercising your privacy rights.

To exercise your California rights, contact us at support@novame.care. We will respond to verifiable requests within 45 days. You may also designate an authorized agent to submit requests on your behalf.

24. Rights for EU/EEA and UK Users (GDPR)

If you are located in the European Union, European Economic Area, or United Kingdom, the following rights apply to you under the General Data Protection Regulation (GDPR) or UK GDPR:

• Right of Access: You may request a copy of the personal data we hold about you.
• Right to Rectification: You may request correction of inaccurate or incomplete personal data.
• Right to Erasure ("Right to be Forgotten"): You may request deletion of your personal data where it is no longer necessary for the purposes it was collected.
• Right to Restriction: You may request that we restrict processing of your personal data in certain circumstances.
• Right to Data Portability: You may request a copy of your data in a structured, machine-readable format.
• Right to Object: You may object to processing based on legitimate interests or direct marketing at any time.
• Right to Withdraw Consent: Where processing is based on consent, you may withdraw it at any time without affecting the lawfulness of prior processing.

Novame processes personal data on the basis of your consent (for optional features such as photo uploads and marketing communications) and legitimate interest (for core platform functionality). Data is processed in the United States. By using the platform, you acknowledge and consent to this transfer.

To exercise your GDPR rights, contact us at support@novame.care. We will respond within 30 days. You also have the right to lodge a complaint with your local data protection authority.

25. Changes to the Service

Novame may update, modify, or discontinue parts of the service at any time. Features, algorithms, and recommendations may evolve as the platform improves.

26. Changes to These Terms

Novame may update these Terms periodically. Continued use of the platform after updates means you accept the revised Terms. The latest version will always be available on the website.

27. Governing Law

These Terms are governed by the laws of the United States and the State of Wyoming, without regard to conflict of law principles. To the extent applicable law requires a different governing law for your jurisdiction (including EU consumer protection law), those mandatory protections shall apply.

28. Severability and Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and KloudStep LLC regarding your use of Novameand supersede all prior agreements.
